Bird Nest Protection

 In England and Wales, all wild birds’ nests, with some limited exceptions, are protected by the Wildlife and Countryside Act 1981. This Act makes it an offence to destroy a nest while it is in use or being built. I understand that birds which habitually use the same nests, including white-tailed eagles, ospreys and golden eagles, have their nests protected year-round, even when not in use.

Through the 25 Year Environment Plan, Ministers are maintaining and extending key protections. The Environment Act 2021 includes a target to halt the decline of nature by 2030 and I would like to assure you that the Government is fully committed to this target. The Act also introduces measures that will strengthen our action for nature and lay the foundation for the Nature Recovery Network, a network of places that are richer in wildlife, more resilient to climate change and provide wider environmental benefits including carbon capture and recreation.
